Daniel Malter LLC (d/b/a "Malter Analytics") ("Malter Analytics," "we," "our," "us") provides access to the MalterAnalytics.com website, the MACK AI Sports Analytics chatbot, and related services (collectively, the "Services").

By creating an account (free or paid), accessing the Services, or otherwise using Malter Analytics, you ("you," "user," "customer") agree to be bound by these Terms & Conditions ("Terms").

If you do not agree, you may not use the Services.

1. Eligibility

• You must be at least 18 years old to create an account, subscribe to any plan, or use the MACK chatbot.
• Use of the Services by anyone under 18 is strictly prohibited.
• International users are welcome, but your use of the Services must comply with all applicable local laws.

2. Account Registration

To use the Services, you must create an account using:

• Email sign-up, or
• Single sign-on (e.g., Google/Gmail)

You agree to provide accurate and current information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts for violation of these Terms.

3. Subscription Plans & Usage Limits

We offer the following plan tiers:

Free Tier — $0/month

• 30 questions per month (resets on first of each month)
• Max 10 questions per day
• Live game data access
• Custom Data Visualization

Pro Tier — $3.99/month

• 500 questions per month (resets on first of each month)
• Max 50 per day
• Live game data access
• Custom Data Visualization
• NFL/NBA Real-Time Fantasy Projections
• Sportsbook Comparisons
• Prop Bet Calculator
• Question History Tracking

MVP Tier — $11.99/month

• 3,000 questions per mont (resets on first of each month)
• No daily limit
• All Pro features included

Enterprise — Custom Pricing

• Connect MACK to your own data
• Custom integrations
• Dedicated account manager

We may modify plan features or limits at any time, but changes will not affect your current billing cycle.

Use of automated tools, bots, or scripts to bypass question limits is strictly prohibited.

4. Billing, Payments & Cancellations

Payments

• Payments are securely processed through Square.
• Accepted payment methods include major credit and debit cards.

Recurring Billing

Paid subscriptions automatically renew monthly unless canceled prior to the next billing date.

Cancellations

• You may upgrade, downgrade, or cancel at any time.
• Changes take effect in the next billing cycle.

Refund Policy

Refunds are not guaranteed. However, you may submit your request through our Contact Us page, and we will review it on a case-by-case basis.

By subscribing, you acknowledge that:

• Access to the Services begins immediately
• You may cancel anytime, but partial refunds for unused time are not guaranteed

5. Changes to Pricing and Subscription Fees

Malter Analytics may modify subscription fees at any time. Any price changes will be communicated to you in advance and will take effect beginning with your next billing cycle. If you do not agree to the new pricing, you may cancel your subscription before the changes become effective. Your continued use of the Service after the effective date of a price change constitutes your acceptance of the updated fees.

6. AI Disclaimers & No-Betting Clause

Malter Analytics uses AI to generate sports insights, statistics, forecasts, predictions, fantasy projections, and betting-related comparisons. You acknowledge and agree that:

6.1 Informational Purposes Only

All information, predictions, and content generated by MACK or provided on the site is for entertainment and informational purposes only.

6.2 No Wagering, Gambling, or Financial Advice

We do not provide:

• Gambling advice
• Betting recommendations
• Financial advice
• Guarantees of accuracy or performance

We never recommend that you place bets under any circumstance.
Any betting decisions you make are entirely at your own risk.

6.3 No Liability for Losses

We are not responsible for any losses, damages, or consequences arising from:

• Using MACK's predictions
• Betting decisions
• Fantasy sports outcomes
• Any financial actions

7. Prohibited Uses

You agree not to:

• Use the Services for gambling, betting, or wagering decisions
• Upload illegal, harmful, or abusive content
• Attempt to scrape, copy, or extract our data, models, forecasts, or outputs
• Circumvent usage limits or security measures
• Reverse-engineer the Services
• Use automated tools to overload or manipulate the platform
• Use the Services in violation of any law or regulation

We may suspend or terminate accounts that violate these rules.

8. User Content

Users may submit text-based questions to the MACK chatbot. No uploads of files, images, videos, or other content are permitted.

We retain the right to moderate or remove any content submitted through the site if it violates these Terms.

Communications submitted through our contact form may be stored for support purposes.

9. Data Collection & Privacy

We collect:

• Account information (email, login details)
• Chat logs and interactions with MACK
• Site analytics data (e.g., via Google Analytics)

We do not currently share personal data with third parties except:

• Essential service providers (e.g., hosting, analytics tools)
• As required by law

We comply with GDPR, CCPA, and other applicable privacy regulations.

10. Intellectual Property

All intellectual property on the site — including the MACK model, analytics tools, data visualizations, code, trademarks, and design — belongs to Daniel Malter LLC (d/b/a Malter Analytics).

Users are granted a limited, revocable, non-transferable license to use the Services solely as permitted under these Terms.

You may not:

• Copy
• Distribute
• Sell
• Derive
• Reverse engineer
• Publicly display
• Or create competing products from

any part of the Services.

11. Service Availability

We strive to maintain reliable access to the Services but do not guarantee:

• Uninterrupted or error-free operation
• Accuracy of real-time data
• Future availability of any feature

We may modify, suspend, or discontinue portions of the Services at any time.

12. Dispute Resolution (Binding Arbitration)

Any disputes arising out of these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You agree that:

• You waive the right to a trial by jury
• You waive the right to participate in class actions
• Arbitration will be conducted individually
• The arbitration will take place in Delaware, unless both parties agree otherwise.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

14. Limitation of Liability

To the fullest extent permitted by law:

• The Services are provided "as is" and "as available"
• We disclaim all warranties (fitness, accuracy, merchantability, etc.)
• We are not liable for any direct, indirect, incidental, or consequential damages, including:
  • Financial losses
  • Betting losses
  • Data loss
  • Business interruption

Maximum liability shall not exceed the amount paid in the past 12 months (or $0 for free users).

15. Termination

We may suspend or terminate your account at our sole discretion if:

• You violate these Terms
• You engage in abusive or fraudulent use
• You misuse the Services or data in any way

Upon termination, your license to use the Services immediately ends.

16. Changes to the Terms

We may update these Terms at any time. If changes are material, we will provide notice on the website or via email. Continued use of the Services after changes indicates acceptance of the revised Terms.
